Customer Sues Retail Giant Target Over Negligence Leading To Injuries

A routine shopping trip turned into a nightmare for a California woman, who is now seeking justice in court. Nancy Magana has filed a complaint against Target Corporation in the Superior Court of California, County of Ventura, on May 1, 2025. The lawsuit accuses the retail giant of negligence and premises liability after an incident at one of its stores left her injured.

According to the complaint, Magana was shopping at the Target store located at 2850 N. Oxnard Blvd., Oxnard, California, on June 28, 2024. As she navigated through Aisle C37 with her shopping cart, an employee pushing a heavily loaded stocking cart collided with her cart. The impact knocked Magana to the ground, resulting in injuries that required multiple surgical procedures to repair damage to her hip and lower back. "The Premises was unsafe for patrons," alleges Magana's legal team from Westlake Injury Law, highlighting that the employee could not see ahead due to the overfilled cart.

Magana contends that Target Corporation and unnamed defendants (referred to as DOES 1 through 50) failed in their duty to maintain a safe environment for customers. The lawsuit claims that these parties were negligent in managing and supervising the store premises and employees. It asserts that Target knew or should have known about the hazardous conditions created by allowing employees to maneuver overstocked carts during business hours without adequate safety measures or warnings for customers like Magana.

The complaint outlines two causes of action: landowner/premises liability and negligence. It argues that Target Corporation had a non-delegable duty to ensure the safety of its premises but breached this duty by failing to prevent dangerous conditions or warn patrons adequately. As a result of this alleged negligence, Magana suffered significant physical injuries leading to permanent disability and incurred substantial medical expenses.

In her prayer for relief, Magana seeks general damages according to proof for pain and suffering endured due to her injuries. She also requests special damages covering medical expenses already incurred and anticipated future costs related to further treatment and therapy. Additionally, she demands compensation for lost income and diminished earning capacity caused by her inability to work following the incident.
