Pilates Studio Faces Lawsuit Over Alleged Negligence Leading to Severe Injury

A shocking incident at a local Pilates studio has led to a lawsuit that could have significant repercussions for fitness businesses. On August 8, 2024, Emily White filed a complaint in the Ventura Superior Court against Michelle Zimmer, WundaBar Pilates Studio, WundaBar Franchising, Inc., and WundaFormer, LLC. The case revolves around allegations of negligence and product liability following an injury sustained by White at the studio.

Emily White, a resident of Ventura County, California, alleges that she was injured on August 24, 2022, while using a piece of equipment known as the WundaFormer at the WundaBar Pilates Studio in Westlake Village. According to the complaint, White was attending a class when the resistance spring connected to the pedal mechanism on the WundaFormer broke and snapped back, striking her left big toe. This incident resulted in severe injuries including lacerations and fractures to her toe. The lawsuit claims that these injuries have caused her significant physical pain and suffering as well as extensive medical expenses.

The defendants named in the lawsuit include Michelle Zimmer and several business entities associated with WundaBar Pilates Studio. The complaint alleges that these parties negligently owned, maintained, controlled, managed, repaired, built, and operated both the premises and exercise machines. Specifically, it is claimed that they failed to properly inspect and maintain the equipment which led to dangerous conditions. "Plaintiff was not warned the springs could break severely injuring her," states one part of the complaint.

White's legal team argues that had proper inspections been conducted according to manufacturer instructions and safety regulations, this accident could have been prevented. The plaintiff also accuses WundaFormer LLC—the manufacturer of the defective machine—of product liability. She asserts that WundaFormer LLC knew their product would be used without inspection for defects but failed to provide adequate warnings about potential dangers.

The lawsuit seeks multiple forms of relief from the court. Emily White is asking for general damages for personal injuries sustained due to alleged negligence and product defects. She is also seeking compensation for past and future medical expenses as well as loss of earnings and earning capacity resulting from her injuries. Additionally, she requests reimbursement for costs related to filing the suit including statutory costs and expert witness fees.
