City Accused of Negligence Leading to Severe Injuries

A lawsuit filed in Ventura Superior Court on July 15, 2024, alleges that a local municipal corporation and two homeowner associations were negligent in maintaining a sidewalk, leading to severe injuries for the plaintiff. The complaint was filed by Myrna Molnar against the City of Thousand Oaks, Village Glen Homeowner’s Association, PMP Management, and other unnamed defendants.

According to the complaint, Molnar was walking with her walker on February 10, 2024, at the intersection of Bight Glen Circle near 1106 Village Glen in Thousand Oaks when she tripped and fell due to a hazardous condition on the sidewalk. The lawsuit claims that the defendants were responsible for planning, designing, constructing, owning, operating, maintaining, entrusting, supervising, and inspecting the area where the incident occurred. "Defendants so negligently and carelessly planned...so as to directly and proximately cause Plaintiff MYRNA MOLNAR with her walker to trip and fall," states the complaint.

Molnar's attorney Andrew L. Shapiro from Lewitt, Hackman, Shapiro, Marshall & Harlan argues that his client suffered serious permanent injuries due to this negligence. The lawsuit details how Molnar experienced physical pain and suffering as well as emotional distress from her injuries. "Plaintiff was hurt and injured in her health...sustaining injury to her body and shock," reads one part of the filing.

The complaint also asserts that the City of Thousand Oaks and other named public entities breached their duties under various sections of California Government Code and Civil Code by failing to remedy or warn about the dangerous condition despite having ample opportunity to do so. "Said public property was in a dangerous and defective condition creating a substantial risk of harm," it continues.

In addition to general damages for pain and suffering, Molnar is seeking compensation for medical expenses incurred due to her injuries. She has also requested costs associated with bringing forth this suit. The plaintiff presented a claim for these damages to the City Clerk's Office of Thousand Oaks on May 30, 2024; however, it was rejected by operation of law.

The case is being overseen by Judge Brenda L. McCormick under Case No: 2024CUPP026956.
