The case centers around an incident on April 26, 2023, where Blackstone Hamilton claims he was subjected to a non-consensual intimate examination by Dr. Tami Jane Simard at Conejo Medical and Breast Care Center. Hamilton alleges that during this examination, he was sexually assaulted and exposed without consent in the presence of an unauthorized female observer falsely represented as a nurse. This incident is said to have violated his bodily autonomy and civil rights. According to the complaint, when Hamilton reported the misconduct and sought redress, he faced retaliation through wrongful termination as a patient.
Hamilton's lawsuit accuses several parties including Conejo Medical and Breast Care Center, Blue Shield of California Life & Health Insurance Company, and the American Board of Family Medicine for enabling or failing to prevent the alleged misconduct. The complaint highlights that institutional defendants failed to implement adequate policies regarding chaperones for male patients and informed consent protocols.
