A serious traffic collision has sparked a legal battle in Ventura County, California. On April 25, 2025, Jose Trinidad Cervantes Rios filed a complaint in the Superior Court of California for the County of Ventura against Laura E. Alvarado, alleging negligence following a car accident that left him injured.

The lawsuit stems from an incident on August 21, 2023, when Rios was stopped at a red light on Oxnard Blvd. in Oxnard, California. According to the complaint, Rios's vehicle was rear-ended by Alvarado's GMC Yukon, causing significant injuries to Rios and damage to his Honda vehicle. The plaintiff claims that Alvarado failed to operate her vehicle safely and violated California Vehicle Code §21703 by not maintaining a safe distance between vehicles. "Defendant’s unsafe driving was in violation of the California Vehicle Code," states the complaint.

Rios is seeking damages for his injuries and losses resulting from the collision. He accuses Alvarado and unnamed defendants (referred to as DOES 1 through 20) of negligence in operating and controlling their vehicle. The plaintiff argues that these defendants had a duty to exercise reasonable care while driving but failed to do so, leading directly to his injuries. The complaint details various breaches of duty by the defendants, including failing to keep a proper lookout for other vehicles and not yielding the right-of-way.

In terms of relief sought, Rios demands compensation for general damages related to pain and suffering, medical expenses incurred both past and future, lost earnings due to his inability to work following the accident, and loss of earning capacity. Additionally, he seeks pre- and post-judgment interest along with any other relief deemed appropriate by the court.

Representing Jose Trinidad Cervantes Rios are attorneys Michael Alder and Ernesto Rodriguez from AlderLaw P.C., located in Valley Village, CA. Richard L. Francis from Law Offices of Richard L. Francis is also listed as counsel for the plaintiff. The case is being overseen under Case No.: 2025 CUPPO42924 in Ventura County Superior Court.
