Nurse transferred to COVID care alleges she was harassed by co-workers

FRESNO -- A woman claims to have been discriminated against and wrongfully terminated at Kaiser Permanente.

Delilah Ramirez filed a complaint on June 3 in Fresno County Superior Court against Kaiser Permanente Fresno Medical Center for statutory discrimination, statutory discrimination harassment, statutory retaliation, violation of health and safety code 1278.5 - retaliation for reporting unsafe patient care and conditions, violation of labor code 6310 and violation of labor code 1102.5.

According to the complaint, Ramirez began her employment at Kaiser Permanente Fresno Medical Center in August 2015 as a part-time Licensed Vocational Nurse. On April 2, 2020, she was assigned/transferred Ramirez to COVID Care at the front of the hospital to screen people for COVID-19. 

On April 3, 2020, Ramirez asked if there would be a rotation of people to work the front screening people for COVID-19, and Ramirez was allegedly told her position in Urgent Care had been dissolved. 

Between April 4-8, 2020, Ramirez became sick, and upon returning to work, she allegedly received a memo "harassing her for not being at work." 

On April 24, 2020, Ramirez allegedly complained about the unfair treatment after an unfavored schedule change which was later scheduled back. Ramirez allegedly filed a discrimination complaint with HR on April 28, 2020, but nothing came of it. 

On May 13, 2020, Ramirez was told others had filed a complaint about her, and she was forced to take time off from May 14 until May 29, 2020, the suit claims. 

Upon returning to work, Ramirez alleged that co-workers retaliated against her, making her work two days in the emergency room. On June 25, 2020, Ramirez filed a Department of Fair Employment Housing (DFEH) complaint with the Equal Employment Opportunity Commission (EEOC). Ramirez also allegedly continued to be yelled at and harassed by co-workers.
