Plaintiff Alleges Premium Outlet Partners Violated Disability Access Laws

Joseph Perez has filed a lawsuit against Premium Outlet Partners, L.P., alleging violations of the Americans with Disabilities Act (ADA) and the Unruh Civil Rights Act (UCRA). The complaint was filed in the Superior Court of California, County of Ventura, on April 22, 2025. Perez claims that the defendant's property, Camarillo Premium Outlets, is not accessible to individuals with disabilities due to numerous architectural barriers.

According to the complaint, Joseph Perez suffers from several physical impairments that limit his mobility and require him to use assistive devices such as a cane or wheelchair. He alleges that during his visits to the Camarillo Premium Outlets on September 16, 2023, and September 29, 2024, he encountered multiple ADA violations. These include lack of an accessible route from the public right-of-way, excessive slopes in parking areas, cracked surfaces within accessible parking areas, inadequately marked access aisles, and non-compliant restroom facilities.

Perez asserts that these conditions violate his rights under both federal and state law. "Disability discrimination is indistinguishable in many ways from race and sex discrimination," he argues in his complaint. He further claims that these violations have denied him full and equal access to the business establishment and continue to deter him from visiting due to ongoing discriminatory conditions.

The plaintiff seeks a declaratory judgment stating that Premium Outlet Partners maintained their property in a manner that discriminated against individuals with disabilities. He requests permanent injunctive relief compelling the defendants to remove all existing ADA violations within 90 days of judgment or by another date deemed fair by the court. Additionally, Perez seeks statutory damages of at least $4,000 per occurrence for each instance of deterrence he experienced at the property.
