In a legal battle that underscores the importance of consumer rights, an individual has taken action against a major automobile manufacturer for alleged breaches of warranty. Rimoun Makhlouf filed a complaint in the Superior Court of California, County of Ventura, on March 6, 2025, accusing FCA US LLC of failing to uphold their obligations under the Song-Beverly Consumer Warranty Act.
The case revolves around a leased 2023 Jeep Grand Cherokee that Makhlouf claims was delivered with significant defects. According to the complaint, these defects include electrical and structural issues as well as transmission problems, which allegedly impair the vehicle's use and safety. The plaintiff asserts that despite multiple repair attempts by authorized service facilities, FCA US LLC failed to resolve these issues within a reasonable timeframe or provide restitution or replacement as required by law.
Makhlouf's legal argument is built on several allegations under the Song-Beverly Act. The first cause accuses FCA US LLC of breaching express warranties by not maintaining the utility or performance of the vehicle. The second cause alleges a breach of implied warranties, arguing that the vehicle was not fit for its intended purpose due to its defective condition. Lastly, Makhlouf claims that FCA US LLC violated Section 1793.2(b) of the Act by not commencing necessary repairs within a reasonable time.
The plaintiff seeks various forms of relief from the court. These include general and special damages, rescission of the purchase contract with restitution for all monies spent, and compensation for any diminution in value. Additionally, Makhlouf requests incidental and consequential damages and a civil penalty amounting to twice his actual damages due to what he describes as willful non-compliance by FCA US LLC. He also seeks coverage for attorney’s fees and costs incurred during this legal process.
