Jessica Gutierrez Garcia has filed a comprehensive lawsuit against her former employer, alleging a series of labor violations and discriminatory practices. The complaint was lodged on March 1, 2025, in the Superior Court of California for the County of Ventura against Karandeep Singh, M.D., P.C., doing business as Oxnard Cardiovascular and Medical Group, and Karandeep Singh individually. This case brings to light serious allegations concerning employment practices that could have far-reaching implications for the defendants.

The plaintiff, Jessica Gutierrez Garcia, accuses her former employer of multiple violations under California's labor laws and Government Code. According to the complaint, Garcia was employed as a cardiovascular technician and later as a medical assistant from October 20, 2022, until her termination on August 26, 2024. She alleges that during her tenure, she was misclassified as an independent contractor rather than an employee. This misclassification led to significant breaches of wage and hour laws, including failure to pay regular wages and overtime, denial of meal and rest breaks, and failure to provide accurate wage statements. The plaintiff also claims that upon her termination, she was not paid all wages due immediately as required by law.

Garcia further alleges discrimination based on sex and pregnancy under the Fair Employment and Housing Act (FEHA). She claims that after notifying her employer about her pregnancy in 2024, she was denied reasonable accommodations typically afforded under California law. The complaint states that instead of engaging in a good-faith interactive process to accommodate her pregnancy-related needs, the defendants treated her unfavorably compared to other employees. Additionally, Garcia asserts that she faced retaliation after raising concerns about these unlawful practices with management.

In terms of relief sought from the court, Garcia is asking for unpaid wages amounting to at least $25,000 plus interest for time worked without compensation. She seeks compensatory damages for emotional distress estimated at $250,000 and lost wages totaling $500,000 due to wrongful termination. Moreover, she demands punitive damages against the defendants for their alleged willful misconduct. Her legal counsel also requests attorney fees and costs incurred while pursuing this litigation.

Representing Jessica Gutierrez Garcia is James Kelly Francis from the Law Office of James Kelly Francis located in Ventura County. The case is identified under Case No. 2025CUWTO39388 in the Superior Court of California for Ventura County.
