Anthony J. Schubert has taken legal action against a prominent automobile manufacturer, alleging significant violations of consumer protection laws due to defects in his luxury vehicle. On March 6, 2025, Schubert filed a complaint in the Superior Court of California, County of Ventura, against Porsche Cars North America, Inc., accusing the company of breaching both express and implied warranties under the Song-Beverly Consumer Warranty Act and engaging in unfair business practices.
The case revolves around a 2022 Porsche Taycan that Schubert purchased on January 15, 2022. He claims that the vehicle exhibited numerous defects and malfunctions that impaired its use, value, and safety. Despite multiple repair attempts by authorized facilities, these issues persisted. Schubert's complaint highlights that Porsche Cars North America failed to conform the vehicle to its express written warranties within a reasonable number of repair attempts or replace it as required by law. "Defendants must refund the price of the Vehicle to Plaintiff," asserts Schubert, referencing California Civil Code §1793.2(d).
Schubert further accuses Porsche Cars North America of breaching implied warranties by selling a vehicle unfit for ordinary purposes. He alleges that the company knowingly placed defective components into commerce and performed negligent repairs with substandard parts. The complaint also charges Porsche with violating California Business & Professions Code §17200 by engaging in unlawful and unfair business practices. Schubert argues that these actions were likely to deceive consumers and contravened public policy.
In seeking justice, Schubert requests various forms of relief from the court. He demands actual damages amounting to $104,050 alongside consequential damages and restitution for all payments made towards the vehicle. Additionally, he seeks civil penalties twice his actual damages under the Song-Beverly Act and coverage for attorney’s fees incurred during this legal battle. The plaintiff also petitions for injunctive relief to halt any further acts constituting unfair competition by Porsche Cars North America.
