A woman is suing a major retail chain for negligence and premises liability following an injury she sustained at one of their locations. Erica Zambrano filed the complaint in Ventura Superior Court on September 9, 2024, against Sam's Club and Walmart, Inc.
According to the court documents, Erica Zambrano was injured on September 22, 2022, while visiting a Sam's Club store located at 2401 N Rose Ave, Oxnard, CA. The incident occurred when Zambrano tripped over an empty dolly cart left unattended near the entrance of the store. The plaintiff alleges that both Sam's Club and its parent company Walmart failed to maintain a safe environment for customers by not removing or adequately warning patrons about the hazardous condition. "Defendants failed to warn patrons at the SUBJECT PROPERTY of the dangerous condition or remedy the dangerous condition," states the complaint.
Zambrano claims that as a result of this negligence, she suffered significant injuries that required medical attention and caused her considerable pain and suffering. She asserts that both companies had a duty to ensure their premises were safe for customers but breached this duty through careless maintenance practices. "Defendants negligently, carelessly, recklessly, and/or unlawfully owned, leased, operated, maintained...the premises," reads another part of the complaint.
The lawsuit seeks general damages for pain and suffering as well as economic damages to cover medical expenses incurred due to the injury. Additionally, Zambrano is asking for interest as allowed by law and reimbursement for court costs. Her attorneys from Alder Law P.C., Michael Alder and Haifa M. Nesheiwat, are representing her in this case.
