A California resident has filed a lawsuit against a well-known retail chain, alleging negligence and premises liability that resulted in serious injuries. The complaint was filed by Patricia Betancourt in the Superior Court of the State of California for the County of Ventura on August 15, 2024, naming Old Navy, LLC as the defendant.
According to the court documents, Betancourt claims that on August 18, 2022, she suffered significant injuries due to unsafe conditions at an Old Navy store located at 205 N. Moorpark Road Space #11 in Thousand Oaks, California. Betancourt alleges that Old Navy and unnamed defendants negligently managed and maintained their premises, which led to her slipping and falling. Specifically, she cites the presence of a plastic hanger on the ground as a dangerous condition that caused her accident.
The plaintiff asserts that Old Navy had either actual or constructive notice of this hazardous condition but failed to take appropriate measures to rectify it. As a result of this alleged negligence, Betancourt sustained injuries affecting her health, strength, motor skills, and overall well-being. She continues to experience physical pain and mental suffering due to these injuries.
Betancourt's complaint outlines two primary causes of action: negligence and premises liability. In both instances, she contends that Old Navy's failure to maintain safe conditions directly led to her injuries. "As a proximate cause of the negligence of Defendant... Plaintiff sustained serious injuries," states the complaint.
The plaintiff is seeking various forms of relief from the court. These include compensation for past and future medical expenses related to her injuries, lost wages due to an inability to work following the incident, and general damages for pain and suffering. Additionally, she requests coverage for legal costs incurred during this litigation process.
Representing Patricia Betancourt are attorneys Arnie E. Goldstein and Robert B. Gurbuz from Goldstein, Gurbuz & Robertson law firm based in Encino, California. The case has been assigned Case No. 2024CUPPO28602 in Ventura Superior Court.
