Plaintiffs Allege Negligence Against Local Driver in Rear-End Collision

In a dramatic legal filing, two Ventura County residents have accused a local driver and his associate of negligence and negligent entrustment, seeking damages for injuries sustained in a car accident. The complaint was filed by Gilbert Anthony Gorham and Gianna Noelle Gorham on August 5, 2024, in the Superior Court of California for the County of Ventura against Ian Robert Cook and Scott Cook.

The plaintiffs allege that on August 31, 2023, they were involved in a severe rear-end collision caused by Ian Robert Cook while he was driving a white 2013 Nissan Altima. According to the complaint, Gilbert Anthony Gorham was operating a gray 2015 Lexus GS 350 at the time of the incident. The accident occurred on westbound Los Angeles Avenue near Sycamore Drive in Simi Valley, California. The plaintiffs claim that they were stopped for traffic when Ian Robert Cook negligently operated his vehicle, causing significant injuries to both plaintiffs.

The lawsuit further contends that Scott Cook and other unnamed defendants (referred to as DOES 1 through 20) are also liable because they owned, maintained, entrusted, and controlled the Nissan Altima driven by Ian Robert Cook. The plaintiffs argue that Scott Cook knew or should have known about Ian Robert Cook's incompetence or unfitness to drive but still allowed him to operate the vehicle. This alleged negligence has led to serious physical injuries and emotional distress for both Gilbert Anthony Gorham and Gianna Noelle Gorham.

The plaintiffs are seeking economic damages for medical expenses incurred due to their injuries and non-economic damages for pain and suffering. They also request compensation for past and future loss of earnings resulting from their inability to work following the accident. In addition to these financial compensations, they are asking for reimbursement of court costs and any other relief deemed appropriate by the court.
