Plaintiffs Allege Negligence Against Driver Following Collision

A serious motor vehicle collision has led to a lawsuit filed in Ventura Superior Court, where two plaintiffs are seeking justice for the injuries they sustained. On August 6, 2024, the Yagoubzadeh Law Firm LLP filed a complaint on behalf of Emily Lianne Ngo and Jaimy Jeeyun Sok against Youth De Mesa Jr. Narkprasert.

The case stems from an incident that occurred on September 30, 2022. According to the complaint, Emily Lianne Ngo was driving her vehicle with Jaimy Jeeyun Sok as a passenger near the intersection of Chestnut and Thompson in Oxnard, California. As Ngo stopped at the intersection to make a right turn, Narkprasert, who was driving a 1998 Chevrolet Malibu behind them, failed to stop and collided with their vehicle. The plaintiffs allege that this collision resulted in significant orthopedic injuries.

Ngo and Sok both reside in California—Ngo in Los Angeles and Sok in Glendale. They claim that Narkprasert's negligent driving directly caused their injuries. The plaintiffs argue that Narkprasert violated several sections of the California Vehicle Code, including Sections 22350 (basic speed law), 23123 (driving while using a wireless telephone), and 21703 (following too closely). These statutes are designed to protect individuals like Ngo and Sok from precisely such negligent behavior.

The complaint further alleges that Narkprasert's actions constitute negligence per se due to his violation of these statutes. Additionally, it is claimed that all defendants involved—including those identified only as Does 1 through 20—owed a duty of care to operate the vehicle safely but breached this duty by acting negligently and recklessly.

As part of their legal action, Ngo and Sok are seeking various forms of relief from the court. They request compensation for economic damages such as medical expenses incurred due to their injuries and non-economic damages for pain and suffering. They also seek prejudgment interest from the date of the incident at the highest rate allowed by law, attorneys' fees where permitted by law, costs associated with bringing the suit, and any other relief deemed just by the court.
