Plaintiff sues retail giant Sam's West Inc. over slip-and-fall incident

A slip-and-fall incident at a retail store has led to a lawsuit filed in Ventura Superior Court, with the plaintiff seeking damages for injuries sustained. On July 17, 2024, Rosa Vazquez filed a complaint against Sam's West, Inc., and Elaine Fellers in the Ventura Superior Court.

According to the complaint, Rosa Vazquez alleges that on September 6, 2023, she was lawfully present at the premises of Sam's West, Inc., located at 2401 N. Rose Ave., Oxnard, CA. The lawsuit claims that the defendants negligently maintained the walkway surfaces, leading to Vazquez slipping and falling. The complaint states that this negligence resulted in serious and permanent injuries for Vazquez. "The dangerous condition was known or should have been known to defendants," reads the complaint, emphasizing that proper measures were not taken to rectify or warn about the hazardous condition.

Vazquez asserts that her injuries have caused significant pain and suffering and will continue to do so in the future. She also claims to have incurred medical expenses and anticipates further costs related to her treatment. Additionally, due to her injuries, Vazquez has been unable to attend her usual occupation, resulting in lost earnings and diminished earning capacity.

The plaintiff is seeking general damages according to proof, special damages for medical expenses, compensation for lost earnings and earning capacity, as well as coverage for legal costs incurred during the suit. The complaint lists two causes of action: negligence and premises liability.
