Ventura Resident Sues Local Driver Over Negligence Leading to Severe Car Accident

A horrific car accident has led to a legal battle as a Ventura County resident seeks justice for injuries sustained in the crash. Enedel Gomez Rivera filed a complaint against Joseph Albert Rago in the Superior Court of California, County of Ventura, on June 28, 2024.

According to the court documents, Rivera alleges that on June 29, 2022, he was involved in a three-car collision on Wells Road at the intersection with Darling Road in Ventura. Rivera's vehicle was stationary due to traffic congestion when it was violently rear-ended by Rago's vehicle. The impact caused Rivera's car to collide with another stationary vehicle ahead of him. The plaintiff claims that Rago's negligence and failure to follow traffic laws were the direct causes of the accident and his subsequent injuries.

Rivera's complaint details several allegations against Rago, including failing to use reasonable care while operating his vehicle, not maintaining a proper lookout for other vehicles, and not keeping a safe distance from the car in front of him. "Defendant Rago failed to anticipate the movements of other vehicles with an equal right to use the roadways," states the complaint. It further accuses Rago of violating multiple provisions of the California Vehicle Code.

The plaintiff is seeking general damages for pain and suffering, medical expenses incurred and anticipated future medical costs, loss of earnings and earning capacity, and other related costs. Rivera demands a jury trial and requests that judgment be entered against Rago for an amount to be determined at trial.
