Plaintiff alleges negligence against Country Club Estates at Moorpark Master Owners Association

Mary Jo Placido has filed a complaint for damages against Country Club Estates at Moorpark Master Owners Association and Property Management Professionals, LLC. The complaint was filed in the Superior Court of California, County of Ventura, on May 21, 2024.

According to the court documents, Mary Jo Placido alleges that on January 28, 2024, she tripped over exposed bolts and nuts protruding from the ground where a stop sign had once stood at the intersection of Hogan Street and Rawls Road in Moorpark, California. Placido claims that this hazardous condition caused her to fall violently to the ground, resulting in significant injuries. The plaintiff asserts that both defendants were responsible for maintaining the premises and failed to ensure it was safe for pedestrians.

Placido's complaint details how she believes the defendants negligently managed and maintained the property. She argues that they failed to inspect and repair dangerous conditions or provide adequate warnings about potential hazards. "Defendants negligently and carelessly owned, managed, maintained, inspected, operated, supervised, controlled and/or repaired the Premises," states the complaint. As a result of this alleged negligence, Placido suffered injuries that have caused her ongoing physical pain and mental suffering.

The lawsuit also mentions violations of applicable building codes by allowing such hazards to exist on their property. Placido claims these violations contributed directly to her accident and subsequent injuries. She further alleges that due to her fall, she has incurred medical expenses and will continue to need medical treatment in the future. Additionally, she has been unable to attend to her usual occupation resulting in lost earnings.

Placido is seeking general damages for pain and suffering as well as special damages for medical expenses incurred due to her injuries. She is also requesting compensation for past and future lost earnings along with other economic damages related to her accident. Furthermore, she seeks prejudgment interest on these amounts along with coverage of court costs.
