In a recent court filing, Carlos Tannos has lodged a complaint against Robert Michael Harlin and Nationwide Transit Corporation for negligence, negligent entrustment, and negligent hiring and supervision. The complaint was filed by attorney Amalia Albaryan on May 14, 2024, in the Superior Court of California, County of Ventura.
The case stems from an incident that occurred on August 20, 2022. According to the complaint, Tannos was driving his 1967 yellow Volkswagen Beetle southbound on the US-101 Highway in Thousand Oaks when he was rear-ended by a 2013 white Eldorado Van driven by Harlin. The van is owned by Nationwide Transit Corporation. The collision resulted in severe injuries to Tannos.
The plaintiff alleges that Harlin was driving at a higher speed than Tannos and failed to notice the slower-moving Volkswagen ahead of him. Despite attempting to maneuver the van to avoid a collision, Harlin struck the right rear of Tannos' vehicle. "Defendant HARLIN was negligent in the operation of the the van," states the complaint.
Furthermore, Tannos claims that Nationwide Transit Corporation is liable for negligent hiring and supervision of Harlin. The company allegedly failed to ensure that Harlin was qualified to operate their vehicle safely. "Defendants NATIONWIDE TRANSIT CORPORATION were negligent in the hiring, training, and supervision of Defendant HARLIN," asserts the document.
Tannos is seeking several forms of relief from the court. These include compensation for past and future general damages, medical expenses, lost earnings and earning capacity, as well as pre- and post-judgment interest and costs incurred during litigation.
