In the Ventura Superior Court, plaintiff Michelle Fox has filed a lawsuit against defendants Ivan Napoli and Rosanna Procopio. The case, with ID 2023CUOR010094, was filed on June 9, 2023. The complaint includes claims for rescission, declaratory relief, elder abuse damages, and more.

The attorneys representing Michelle Fox are Kenneth M. Lipton and an unidentified lawyer from Pacific Palisades. According to the complaint, Fox alleges that Napoli and Procopio took advantage of her age to purchase a 41-acre parcel of land in Ventura County under unfair terms. The land was sold for $30,000 with a seven percent per annum interest rate.

Fox further alleges that she transferred her undivided interest in the property to the defendants via a Grant Deed executed on October 10, 2022. She also claims that Napoli and Procopio signed a Note Secured by Deed of Trust for the balance due for the sale of the property amounting to $24,278.66.

Michelle Fox is seeking judgment against Ivan Napoli and Rosanna Procopio for damages related to elder abuse as well as rescission of the property sale agreement and declaratory relief. The amount in controversy exceeds the jurisdictional limit of this court.
