Family of man shot, killed by police after allegedly shooting his ex-girlfriend in the head sues San Diego for $30M

The family of Imanol Aparicio, who was shot and killed by San Diego Police after allegedly shooting his ex-girlfriend in the head, has filed a $30 million lawsuit against the city. 

The suit was filed in San Diego federal court on Feb. 12 by attorney LeRoy George Siddell, on behalf of Elizabeth Cruz and Richard Cruz, identified as Aparicio's parents.

The complaint alleges wrongful death and damages due to excessive force under federal law. It claims that the police officers involved allegedly did not give an adequate verbal warning before shooting Aparicio. The family's lawsuit claims Aparacio posed no immediate threat at the time. The lawsuit also accuses the officers of tampering with the shooting location.

According to published reports, police say Aparicio allegedly shot his ex-girlfriend in the forehead, and then allegedly appeared to reach for a gun in his pants when confronted by officers.

Elizabeth Cruz, Aparicio's mother, is said to have been emotionally and financially dependent on her son. The plaintiffs are seeking both survival and wrongful death damages for the violation of Aparicio’s rights.
