FRESNO -- A woman claims that her personal medical information was obtained by others than preferred medical personnel when an email was leaked.
Jane Doe filed a complaint on May 20 in Fresno Superior Court against Trinity Health Corporation and Does 1-100 for violation of Confidentiality of Medical Information Act Civil Code 56, Breach of California Security Notification Laws and Business and Professions Code 17200.
According to the complaint, in January, Trinity Health created, maintained, preserved, and stored records of the care, services and products, including the names, addresses, email addresses, dates of birth, healthcare providers, dates and types of healthcare services, medical record numbers, immunization types, lab results, medications, payments, payer names and claims information of Jane Doe.
On Jan. 29, 2021, Trinity Health allegedly had a security issue with its file transfer platform, in which Jane Doe's personal information was accessed to those outside the secure medical facilities and approved locations of Jane Doe.
Doe seeks nominal damages in the amount of $1,000 for each instance in which her personal information was used; damages due to the unlawful, fraudulent and unfair business acts and practices; injunctive relief; attorney's fees; and cost of suit.
