FRESNO -- A woman is suing Amazon for allegedly suffering disability discrimination and wrongful termination.
Stephanie Hernandez filed a complaint on May 13 in Fresno Superior Court against Amazon.com and Does 1-25 for disability discrimination, retaliation, failure to prevent, failure to engage in interactive process, wrongful termination, breach of employment contract and breach of implied covenant of good faith and fair dealing.
According to the complaint, Hernandez began working for Amazon.com on July 19, 2018 as a "Picker." On April 25, 2019, Hernandez allegedly was experiencing dizziness which worsened during her shift.
Hernandez went to the in-house health clinic, where she was told nothing could be done there for her. Hernandez allegedly then informed her manager of leaving work to seek medical attention.
On April 26, 2019, Hernandez was placed her on a temporary disability for vertigo through April 30, 2019, the suit says, and turned in a medical note. Hernandez returned to work on May 1, 2019 until May 11, 2019 and had May 12,13 and 14 off, she says.
Hernandez allegedly returned to work on May 15, 2019, and her employee badge was not working. Hernandez reported the issue and was told that she had been terminated.
Hernandez seeks compensatory and general damages, attorneys’ fees and costs and punitive damages. Hernandez is represented by Edward B. Chatoian II.
