Bathroom at The Break Room too small for people in wheelchairs, lawsuit says

LOS ANGELES - A Fullerton bar/tavern was accused of violating the Americans with Disabilities Act (ADA) in a March 16 lawsuit filed in the Central California District Court. 

Plaintiff Ruben Paul Gonzales is disabled and uses a wheelchair for mobility. He visited defendant The Break Room, owned by IV Enterprises LLC and Tomp William Alfred TR, in October 2020. 

Gonzales says that he was unable to use the restroom at the bar because it was too small for him to turn and maneuver his wheelchair, and the sink was too high for a disabled person to reach. The urinal was also allegedly placed in a way that prevents disabled people from using the bathroom facilities. 

The Break Room and its owners are charged with violating the ADA, violating the Unruh Civil Rights Act, violating the California Disabled Persons Act and general negligence.

The defendants are subject to $4,000 for each violation, the lawsuit claims.
