A California resident has taken legal action against a local business establishment, alleging violations of disability rights laws. Anthony Bouyer filed a complaint in the Superior Court of California, County of Ventura, on April 7, 2025, against F. Oliveira Ranch Company and DS Mandalay Village, LLC. The lawsuit accuses these entities of failing to comply with the Americans with Disabilities Act (ADA) and the Unruh Civil Rights Act (UCRA), which protect individuals with disabilities from discrimination.

The case centers around an alleged visit by Bouyer to a property located at 533 W Channel Islands Blvd in Port Hueneme, California, where he claims to have encountered several barriers that hindered his access due to his mobility impairments. Bouyer relies on leg braces, a walker or wheelchair for mobility, and hand control devices for driving. He asserts that the property failed to meet ADA standards during his visit on February 7, 2024. Specifically, he highlights issues such as sloped access aisles exceeding permissible grades and inadequate parking facilities for disabled patrons.

Bouyer's complaint underscores the importance of ensuring public accommodations are accessible to all individuals regardless of their physical abilities. He argues that these violations have denied him full and equal access to the services offered at the business premises. The lawsuit seeks declaratory judgment acknowledging these violations and requests permanent injunctive relief mandating the defendants rectify all ADA non-compliance issues within a specified timeframe.

Additionally, Bouyer is pursuing damages under California law for each instance of deterrence he experienced due to these accessibility barriers. He also seeks reasonable attorney fees and litigation expenses as part of his legal action against F. Oliveira Ranch Company and DS Mandalay Village, LLC.

Representing Bouyer in this matter is Joseph R. Manning Jr., Esq., from Manning Law APC. The case has been assigned Case No. 2U25CIICRO4A1653 in the Superior Court of California for Ventura County.
