"Defendants maintained a systematic policy of failing to pay employees for all hours worked," states the complaint, highlighting systemic issues within the company's operations from February 2021 to May 2024.

Arciniega's lawsuit is comprehensive in its scope. It details how employees were often required to work off-the-clock without compensation and were denied uninterrupted meal breaks. Additionally, it alleges that necessary business expenses incurred by employees were not reimbursed. These practices are claimed to be in direct violation of several sections of the California Labor Code and Industrial Welfare Commission Wage Orders. "Plaintiff was typically scheduled to work at least five days a week and often more than eight hours per day," the document notes, emphasizing the extent of alleged labor exploitation.

The legal action seeks various forms of relief from the court. Arciniega is pursuing recovery for unpaid wages along with liquidated damages as stipulated under California law. The suit also demands civil penalties under the Private Attorneys General Act (PAGA), aiming to secure restitution not just for himself but also on behalf of similarly aggrieved employees. Furthermore, it calls for injunctive relief to prevent future violations by B & S Plastics.
