A slip-and-fall incident at a popular California venue has led to a lawsuit alleging negligence and premises liability. On March 4, 2025, Ricardo Mercado filed a complaint in the Superior Court of California, County of Ventura, against Calamigos at the Vineyards, Inc., and several unnamed defendants. The case stems from an accident that occurred on March 18, 2023, when Mercado slipped on water in the men's restroom at the defendant's property in Simi Valley.

According to the complaint filed by Mercado's attorney, Justin P. Dixon of Dixon & Daley LLP, the plaintiff was lawfully using the premises located at 2525 Stow Street when he encountered a hazardous condition—a wet floor without any warning signs or safety measures in place. The complaint alleges that Calamigos at the Vineyards and other fictitiously named defendants were negligent in maintaining and supervising their property. "Defendants negligently, carelessly, recklessly and unlawfully maintained...the premises," states the complaint, emphasizing that this negligence directly caused Mercado's injuries.

Mercado asserts that each defendant acted as an agent or employee of one another and thus shares responsibility for his injuries. He claims that all parties involved should have known about the dangerous condition but failed to provide adequate warnings to him or other patrons. As a result of this oversight, Mercado suffered severe injuries impacting his health and ability to work.

The plaintiff is seeking various forms of relief from the court. These include general damages for pain and suffering, compensation for medical expenses incurred due to his injuries, and damages for loss of earnings and earning capacity. Additionally, Mercado requests reimbursement for legal costs associated with pursuing this lawsuit.
