Lloyd Mosley, a California resident with physical disabilities, has filed a lawsuit against Automatic Properties, LLC in the Superior Court of California, Ventura County on February 13, 2025. The complaint alleges that the defendant failed to provide accessible facilities for disabled individuals at a parking lot serving a barbershop located at 1771 E. Thousand Oaks Blvd., Thousand Oaks, CA.
According to the complaint filed by Mosley's attorney, Dayton Magallanes of the Law Offices of Dayton Magallanes, Mosley visited the barbershop on March 1, 2024. As a quadriplegic who relies on a wheelchair for mobility, he encountered significant barriers due to the absence of designated van-accessible handicapped parking spots with an adjacent access aisle and proper signage. This failure denied him full and equal access to the barbershop's services, causing him difficulty and embarrassment.
Mosley contends that Automatic Properties' actions violate several laws including Civil Code Section 51 and the Americans with Disabilities Act (ADA). He argues that the lack of accessible parking is a clear violation of ADA standards for accessible design and California regulations. The complaint further states that these barriers are easily removable without much difficulty or expense and that their removal is considered readily achievable by law.
The plaintiff seeks injunctive relief compelling Automatic Properties to comply with the Unruh Civil Rights Act by removing all accessibility barriers related to his disability. Additionally, Mosley requests damages under this act which includes actual damages and a statutory minimum penalty of $4,000. He also seeks reasonable attorney’s fees and litigation costs as part of his legal relief.
