A California employee has filed a lawsuit against multiple business entities, accusing them of violating labor laws and seeking civil penalties. On February 11, 2025, Joshua Daniel Gibson filed a complaint in the Superior Court of California, County of Ventura, against JM Big Bear LP and other associated companies.
The case centers around alleged violations under the Labor Code Private Attorneys General Act (PAGA) of 2004. Gibson claims that these businesses have systematically violated numerous sections of the California Labor Code, affecting himself and other aggrieved employees. The allegations include failure to pay overtime wages, inaccurate tracking of work hours, improper wage deductions, and failure to provide meal and rest breaks as required by law. According to the complaint, "Defendants violated Labor Code sections 221, 222, 223... by failing to accurately track and/or pay for all minutes actually worked." Furthermore, Gibson accuses the defendants of failing to maintain comfortable working conditions as mandated by California regulations.
Gibson's legal action seeks to recover civil penalties on behalf of himself and other affected employees for these alleged violations. The plaintiff is asking for compensation that includes unpaid wages for overtime work not properly compensated due to various practices such as detrimental rounding of time entries and manipulation of recorded work hours. The complaint also highlights issues related to workplace safety and inadequate facilities provided by the employers. In addition to financial compensation, Gibson seeks injunctive relief requiring the defendants to comply with labor laws moving forward.
The plaintiff is represented by attorneys from Bibiyan Law Group P.C., including David D. Bibiyan and Sarah H. Cohen. The case is presided over by Judge Aronda L. McCormick in Ventura County Superior Court under Case No. 2025 CUMMEOS81 34.
