In a significant legal development, a class action lawsuit has been filed against a company accused of violating labor laws by failing to pay its employees appropriately. On February 10, 2025, Luid A Rubio Velazquez filed the complaint in the Superior Court of California, County of Ventura, against OVIS LLC and other unnamed defendants.
The lawsuit alleges that OVIS LLC engaged in multiple violations of California's labor laws. According to the complaint, Velazquez and similarly situated employees were not compensated for all hours worked at minimum wage or overtime rates as required by law. The plaintiff claims that OVIS LLC failed to authorize or permit meal and rest periods, provide accurate wage statements, and timely pay all earned wages upon employment termination. The complaint outlines specific breaches of Labor Code Sections 1194, 1197, 510, 512, 226.7, and others. "Defendants suffered, permitted, and required their hourly non-exempt employees to be subject to Defendants’ control without paying wages for that time," the complaint states.
Velazquez worked for OVIS LLC from September 14, 2022, until December 3, 2024. During this period, he alleges that the company required him and other employees to remain on duty during breaks by keeping earpieces on for instructions and updates. This practice allegedly resulted in unpaid work hours which should have been compensated at minimum wage or overtime rates when applicable.
The plaintiff is seeking several forms of relief from the court: unpaid wages with interest; statutory penalties; injunctive relief; reasonable attorneys' fees; costs; and restitution under California Business and Professions Code sections 17200 et seq., which addresses unfair business practices. Velazquez also demands a jury trial for himself and other class members.
