Consumer Alleges Auto Manufacturer Breached Warranty Obligations

Leanne Marie Garcia has filed a lawsuit against FCA US LLC, alleging significant breaches of warranty and unfair business practices. The complaint was lodged in the Superior Court of California, County of Ventura, on January 31, 2025. The case revolves around a defective vehicle sold by FCA US LLC to Garcia, which she claims failed to meet the standards promised under both express and implied warranties.

According to the complaint, Garcia purchased a 2021 Jeep Wrangler 4XE from FCA US LLC on May 19, 2024. She asserts that the vehicle was sold with express warranties guaranteeing it would be free from defects in materials and workmanship. However, shortly after acquiring the vehicle, Garcia began experiencing numerous issues that rendered it unfit for its intended use. Despite repeated attempts to have these defects repaired under warranty at authorized service centers, FCA US LLC allegedly failed to resolve the problems.

Garcia's legal action cites violations of the Magnuson-Moss Warranty Act and California's Business and Professions Code Section 17200. She argues that FCA US LLC breached its written and implied warranties by failing to provide a product that performed as promised. "The subject vehicle did not perform as promised and is unfit and unreasonably dangerous for ordinary use," states the complaint. Additionally, Garcia accuses FCA US LLC of engaging in unlawful business practices by knowingly selling defective vehicles without proper disclosure or remedy.

The plaintiff seeks various forms of relief from the court, including actual damages amounting to $58,600.08, consequential damages, restitution for all payments made towards the vehicle, civil penalties under the Song-Beverly Act amounting to twice her actual damages, and reasonable attorney fees. Furthermore, Garcia requests injunctive relief to prevent further unfair competition by FCA US LLC and demands an accounting of all profits derived from such practices.
