Carlos Hernandez has filed a class action lawsuit against his former employer, alleging numerous violations of California labor laws. The complaint was filed on January 31, 2025, in the Superior Court of California, County of Ventura, against Cappo Management XXXII, Inc., doing business as Ocean Honda of Ventura.
Hernandez claims that the company systematically failed to comply with several provisions of the California Labor Code and engaged in unfair business practices. According to the lawsuit, Cappo Management did not pay minimum wages or overtime compensation as required by law. The complaint also accuses the company of failing to provide meal and rest periods, maintain accurate records of hours worked and meal periods taken or missed, indemnify necessary business expenses, timely pay final wages upon termination, and furnish accurate wage statements. Hernandez alleges that these violations were part of a broader pattern affecting other employees similarly situated.
The plaintiff seeks class certification for this case on behalf of himself and other hourly-paid, non-exempt employees who worked for the defendant during the applicable statute of limitations period. He argues that a class action is superior to individual lawsuits due to the commonality of legal questions involved and the impracticality of joining all affected employees in one suit. Hernandez asserts that he and other class members have suffered monetary injury due to these unlawful practices.
Hernandez's legal team is seeking various forms of relief from the court. These include unpaid wages for all hours worked (including overtime), liquidated damages for failure to pay minimum wages, statutory penalties for failure to provide accurate wage statements and timely final payments upon termination, reimbursement for business expenses incurred without indemnification, injunctive relief to prevent future violations by the defendant, and attorneys' fees and costs associated with bringing this action.
The case is being handled by attorneys Seung L. Yang and Tiffany Hyun from The Sentinel Firm APC. The presiding judge has yet to be named in Case No.: 2OPSCLUOEOSYY3s.
