Customer Sues Fast-Food Chain Over Alleged Negligence Leading To Injury

Brenda Acosta has filed a lawsuit against a prominent fast-food chain, alleging negligence and premises liability after suffering injuries at one of their locations. The complaint was filed by Brenda Acosta on October 13, 2024, in the Superior Court of California, County of Ventura, naming McDonald's and Clayton Paschen III DBA McDonald's among others as defendants.

The case centers around an incident that occurred on January 5, 2023, when Brenda Acosta visited a McDonald's restaurant located at 401 Ventura Avenue in Oxnard, California. According to the complaint, the plaintiff claims she encountered hazardous conditions at the premises which led to her fall and subsequent injuries. She accuses them of negligently owning, leasing, operating, maintaining, designing, installing, building, managing, supervising, inspecting or otherwise controlling the premises where the accident took place. Furthermore, she claims that these entities had ample opportunity to discover and rectify these hazardous conditions but failed to do so.

The legal action brought forth by Acosta includes two primary causes: negligence and premises liability. She argues that all defendants owed her a duty of care to ensure safety on their property but breached this duty through their actions or lack thereof. As a result of this breach of duty by the defendants – including unnamed parties referred to as DOES 1 through 100 – Acosta experienced physical injuries requiring medical treatment along with pain and suffering. Additionally noted are losses related to earnings capacity due to her injuries.

Acosta seeks various forms of relief from the court including general damages according to proof presented during trial; compensation for past and future medical expenses; reimbursement for lost earnings both past and future; damages for impaired earning capacity; property damage compensation; prejudgment interest pursuant to Civil Code §3291; costs incurred during litigation proceedings; as well as any other appropriate relief deemed necessary by the court.
