Former Employee Alleges POM Medical LLC & Stryker Employment Company Violated Labor Laws

A former employee has filed a lawsuit against two companies, alleging widespread labor violations that could affect numerous current and former employees. On November 25, 2024, Mayra Manzano filed a complaint in the Superior Court of California, County of Ventura, against POM Medical LLC and Stryker Employment Company LLC. The lawsuit accuses these companies of violating several provisions of the California Labor Code under the Private Attorneys General Act (PAGA).

Mayra Manzano, who worked as a quality control inspector at POM Medical's Moorpark facility until February 2024, claims that the defendants engaged in unlawful employment practices. According to the complaint, these practices include failing to pay for all hours worked—including overtime—improperly calculating regular rates and sick leave wages, not paying minimum wage or wages owed twice per month, and denying rest and meal breaks. The plaintiff alleges that these violations were willful and intentional policies by the defendants to increase profits at the expense of their employees.

The lawsuit further accuses the defendants of failing to reimburse business expenses, such as requiring employees to use personal phones for work-related tasks without compensation. Additionally, it claims that upon termination, employees were not paid all due wages or accrued vacation time promptly. The complaint also highlights issues with inaccurate wage statements and failure to provide personnel records when requested.

Manzano is seeking civil penalties under PAGA on behalf of herself and other aggrieved employees. She aims to recover penalties for each violation of labor laws committed by the defendants during her employment period. The relief sought includes civil penalties as specified under various sections of the California Labor Code, reasonable attorneys' fees and costs, pre-judgment interest, and any other relief deemed appropriate by the court.
