Philadelphia Indemnity Insurance Company has filed a lawsuit accusing an individual of orchestrating a fraudulent scheme involving theft and embezzlement. The complaint was filed on January 21, 2025, in the Superior Court of California, County of Ventura, against Shannon Farnsworth.
According to the lawsuit, Philadelphia Indemnity Insurance Company had issued an insurance policy to the Boys and Girls Club of Camarillo that covered theft and embezzlement losses. The plaintiff alleges that Shannon Farnsworth engaged in a scheme to defraud the insured by using their credit cards for unauthorized purchases. This alleged activity is said to have violated California Penal Code §503, which pertains to theft by embezzlement. Due to the amount involved exceeding $950, it also qualifies as grand theft under California Penal Code §487.
The insurance company claims that these fraudulent acts resulted in economic damages amounting to at least $92,062.01 for the insured party. Consequently, the Boys and Girls Club of Camarillo filed a claim with Philadelphia Indemnity Insurance Company under their policy for this loss. The insurance company paid out this claim as per their agreement with the insured party.
Asserting its rights as the subrogee or assignee of the insured's claim, Philadelphia Indemnity Insurance Company believes it holds a superior equitable position over any defendant in this case. They argue that Shannon Farnsworth should be held responsible for reimbursing them for the loss incurred due to her alleged actions.
In its prayer for relief, Philadelphia Indemnity Insurance Company seeks economic damages totaling $92,062.01 from Shannon Farnsworth and any other unnamed defendants involved in this case. Additionally, they request interest on these damages starting from May 20, 2024, along with reimbursement for legal costs incurred during this litigation process.
