Motorcycle Buyer Alleges Negligence Against Local Dealership Over Defective Handlebar

A harrowing incident involving a defective motorcycle has led to a lawsuit filed in Ventura Superior Court, bringing to light allegations of negligence against a local dealership. On September 9, 2024, Jerome Moiso lodged a complaint against Simi Motorsports, LLC and Tri-County Powersports, claiming their actions led to his severe injuries.

According to the court documents filed by Moiso's attorneys from Quirk Law Firm, LLP, the case centers around an accident that occurred on October 27, 2023. Moiso had purchased a 2023 Can-Am Spyder from the defendants on August 24, 2023. Shortly after the purchase, employees or agents of Simi Motorsports and Tri-County Powersports adjusted the handlebar of the vehicle. However, Moiso alleges that this adjustment was done negligently—specifically that the bolts on the handlebar stem were not properly tightened.

The complaint details how this alleged negligence resulted in Moiso losing control of his Can-Am Spyder when its handlebar suddenly moved out of position while he was riding it. The unexpected movement caused him to crash and sustain significant injuries. The document states that Moiso suffered injuries affecting his health, strength, and activity levels. Additionally, he experienced shock and injury to his nervous system which has led to ongoing physical and mental pain.

Moiso asserts that due to the defendants' conduct, he has incurred substantial medical expenses and anticipates further costs for continued medical care. Furthermore, he claims lost earnings both past and future as well as a diminished earning capacity due to his injuries. The plaintiff also mentions property damage resulting from the crash but does not specify an amount at this stage.

In seeking justice through this lawsuit, Moiso is asking for general damages exceeding the minimum jurisdictional limits of the court. He is also seeking special damages according to proof presented during trial along with costs incurred from filing the suit. Moreover, Moiso is requesting exemplary damages on one count of negligence and any other relief deemed appropriate by the court.
