Plaintiff Alleges Negligence Against Grocery Chain Following Severe Injury

A California resident has filed a lawsuit against a major grocery chain, alleging negligence and premises liability following a severe injury at one of its stores. The complaint was lodged by Nasrin Rastegar in the Superior Court of California, County of Ventura, on September 11, 2024, targeting The Vons Companies, Inc.

Nasrin Rastegar claims that she suffered significant injuries due to Vons' failure to maintain safe conditions at their Thousand Oaks location. According to the court documents, on September 3, 2022, Rastegar visited the store for grocery shopping when she slipped on a liquid substance near the bakery area. The incident left her with severe pain and dizziness, particularly in her right ankle. "Recognizing the severity of her injuries," Rastegar states that she returned to the store where employees called an ambulance for immediate medical attention.

The plaintiff asserts that Vons had both actual and constructive notice of the hazardous condition but failed to address it adequately. "Defendant had actual and/or constructive notice or should have inspected the dangerous condition," reads the complaint. It further alleges that Vons neglected its duty to regularly inspect and ensure safe premises for all invitees. As a result of this negligence, Rastegar sustained serious physical injuries affecting her ankles, back, neck, legs, and arms along with significant emotional distress.

Rastegar is seeking general damages according to proof, special damages as proven at trial, all statutorily allowed damages including interest at the legal rate, costs incurred during the suit, and any other relief deemed just by the court. The lawsuit emphasizes that Vons' total disregard for safety constitutes a breach of duty which directly led to her injuries.
