Transit Company Sued Over Alleged Negligence Resulting in Passenger Injury

A serious negligence lawsuit has been filed against a local transit company following an incident that left a passenger with severe injuries. The complaint, submitted by Ricardo Nolazco Anaya on September 5, 2024, in the Ventura Superior Court, names Ventura Transit System, Inc., and one of its employees, Edgar Doe, as defendants.

According to the filing by Alder Law, P.C., representing Anaya, the plaintiff was injured on August 26, 2023, when a folded wheelchair was not properly secured in a van operated by Ventura Transit System. This alleged negligence caused the wheelchair to fall onto Anaya, resulting in significant harm. "Defendant Edgar Doe had a legal duty to drive, operate and otherwise control the bus in a reasonably safe manner," states the complaint. It further accuses Doe of failing to ensure passenger safety during his employment with Ventura Transit System.

The lawsuit outlines three main causes of action: negligence, negligent entrustment, and negligent hiring, supervision & retention. Anaya asserts that Ventura Transit System negligently entrusted their vehicle to Doe despite knowing or having reason to know he was unfit for his duties. The complaint details how this lack of proper oversight led directly to Anaya's injuries. "Defendants VENTURA TRANSIT SYSTEM INC., and DOES 1 through 25 knew or should have known that Defendant EDGAR DOE was incompetent or unfit to operate the van," reads one section.

Anaya is seeking various forms of relief from the court including past and future general damages for pain and suffering as well as special damages for medical expenses incurred due to the incident. The plaintiff also demands pre- and post-judgment interest and coverage of legal costs associated with bringing this suit forward.
