Woman Sues Public Entities Over Dangerous Sidewalk Condition

A woman is taking legal action against multiple public entities, claiming their negligence led to her serious injuries. Barbara Sanchez filed a complaint on August 30, 2024, in the Superior Court of California, County of Ventura, against the City of Oxnard, County of Ventura, and the State of California.

According to the court documents, Sanchez alleges that on April 10, 2024, she tripped and fell over a significant concrete displacement on a sidewalk located at 2710 Volcano Court in Oxnard. She claims that the defendants negligently owned, operated, designed, planned, supervised, altered, amended, built, constructed, developed, managed, repaired and maintained the premises. The complaint states that this dangerous condition posed an unreasonable risk of harm which Sanchez was unaware of at the time.

Sanchez's attorneys argue that the public entities failed to fix or warn about the dangerous condition despite being aware or should have been aware of it. "Defendants negligently allowed Plaintiff and invitee access to the dangerous condition; negligently failed to construct a barrier around the dangerous condition; and negligently failed to take steps to either make the condition safe or warn Plaintiff," reads part of the complaint.

The plaintiff seeks general damages for personal injuries under Civil Code § 3333 and Government Code §§ 835 and 815.2. Additionally, she is asking for compensation for medical expenses incurred due to her injuries and loss of past and future earnings. The complaint also mentions that Sanchez had complied with all applicable claims statutes by presenting her claims to each defendant within specified timeframes but received no satisfactory response.
