Pedestrian Sues Driver for Negligence Following Crosswalk Collision

A tragic pedestrian accident has led to a legal battle in Ventura County, California. The complaint was filed by Liborio Tapia Lopez on August 16, 2024, against Guadalupe Mireles Lopez in the Superior Court of California, County of Ventura. The plaintiff alleges negligence resulting in serious injuries.

According to the complaint, the incident occurred on September 15, 2022, when Liborio Tapia Lopez was crossing at the intersection of Second Street and Ventura Road in Oxnard. As he stepped onto the crosswalk, Guadalupe Mireles Lopez allegedly failed to yield the right-of-way while making a left turn from Second Street onto Ventura Road. This failure resulted in a collision that caused significant injuries to Mr. Lopez.

The plaintiff's attorney, Omid Razi from Razi Law Group, claims that Guadalupe Mireles Lopez’s actions were negligent and violated California Vehicle Code § 21950(a), which mandates drivers to yield to pedestrians within any marked or unmarked crosswalks at intersections. "Defendant’s vehicle collided with the Plaintiff, resulting in significant injury," states the complaint. It further accuses Ms. Lopez of failing to approach the intersection with due care and being inattentive at the time of the collision.

Liborio Tapia Lopez is seeking several forms of relief from the court. He demands repayment for all special damages incurred, including past and future wage loss and medical expenses. Additionally, he seeks general damages according to proof, prejudgment interest as allowed by law, costs of suit incurred herein, and any other relief deemed just and proper by the court.
