Care Center Sued Over Alleged Negligence Leading To Severe Injury

A slip-and-fall incident at a care center has led to a lawsuit alleging negligence and premises liability. On July 26, 2024, Colleen McCarthy filed a complaint in the Ventura Superior Court against Greenfield Care Center of Fillmore, LLC. The case centers around an accident that occurred on July 15, 2023, when McCarthy slipped on leaves while walking on the back patio of the care center.

According to the complaint, McCarthy was severely injured after slipping on leaves and falling onto concrete. She alleges that Greenfield Care Center and unnamed defendants (Does 1 through 50) were negligent in maintaining the property. The lawsuit claims that these defendants owned, managed, or controlled the premises and failed to ensure it was safe for visitors. "Defendants failed to exercise reasonable care in the leasing, inspection, management, control, ownership, possession, use, maintenance, design, and operation of the SUBJECT PREMISES," states the complaint.

McCarthy's attorneys argue that Greenfield Care Center had a duty to maintain a safe environment but neglected this responsibility by allowing hazardous conditions to persist. The lawsuit further alleges that the defendants knew or should have known about the dangerous condition presented by the leaves on the patio but did nothing to remedy it. "Defendants negligently knew or should have known of the dangerous condition and allowed it to remain for a sufficiently lengthy period of time," reads another part of the complaint.

The plaintiff is seeking various forms of relief from the court. These include general damages for pain and suffering as well as special damages for medical expenses incurred due to her injuries. Additionally, she seeks compensation for loss of earnings and future earning potential. The complaint also requests prejudgment and post-judgment interest according to law and proof.

The case is being handled by attorneys Arash Zabetian and Tom Vertanous from Martinian Lawyers Inc., with Judge Brenda L. McCormick presiding over it under Case ID: 2024CUPP027641.
