A serious personal injury lawsuit has been filed against a major grocery chain and its affiliates. On July 24, 2024, Alder Law, P.C., on behalf of Lilia Aguilar Ramirez, submitted a complaint to the Superior Court of California, County of Ventura, naming Vons, The Vons Companies, Inc., Albertsons Companies, Inc., and an individual named Trina Carter as defendants.
The case revolves around an incident that occurred on August 8, 2022. According to the complaint, Ramirez was shopping at a Vons store located at 450 S Ventura Rd in Oxnard, California when she slipped on water near the cash registers and fell backward. This fall allegedly resulted in serious and permanent injuries. The plaintiff claims that the defendants failed to warn patrons about the dangerous condition or take steps to remedy it. "Defendants had a duty to use reasonable care to keep the area in a safe condition for use by Plaintiff RAMIREZ and others similarly situated," states the complaint.
Ramirez asserts that Vons and its parent company Albertsons were negligent in maintaining their premises. The complaint alleges that Trina Carter, an employee and associate manager at the store, along with other unnamed individuals (referred to as DOES 1 through 100), were responsible for ensuring the safety of the store environment but failed in their duties. The lawsuit contends that these failures constitute negligence and premises liability under California law.
The plaintiff is seeking general damages for pain and suffering, economic damages for medical expenses incurred due to her injuries, interest as allowed by law, costs of suit incurred, and any other relief deemed just and proper by the court.
