A routine medical procedure turned into a nightmare for a California woman, leading to a legal battle against a prominent imaging center. Jessica Williams filed a complaint on July 11, 2024, in the Ventura Superior Court against Grossman Imaging Center of CMH, LLC, alleging negligence that resulted in severe injury.
The case revolves around an incident on May 15, 2023, when Williams visited Grossman Imaging Center in Oxnard for a routine mammogram. According to the complaint, the technician performing the procedure—referred to as Doe No. 1—pressed Williams' breast excessively hard despite being informed about her breast implants. Three days later, Williams discovered a large lump under her armpit and was subsequently diagnosed with a ruptured breast implant after visiting Dignity Health's Emergency Department on June 4, 2023. The rupture led to an infection requiring immediate surgery and an extended hospital stay of approximately two months.
Williams alleges that the technician's actions were negligent and directly caused her injuries. "Despite Plaintiff's complaints, the technician continued to press Plaintiff's breast very hard," states the complaint. The lawsuit also accuses Grossman Imaging Center of failing to ensure the competence of its medical staff as mandated by California Code of Regulations Title 22. The plaintiff claims that this failure contributed significantly to her injuries and subsequent suffering.
The legal document outlines multiple causes of action against both named and unnamed defendants (Does 1 through 100). It highlights that Grossman Imaging Center had a duty to provide reasonable care and ensure all medical personnel were competent. "Defendant Grossman Imaging Center of CMH, LLC breached its duty by failing to use reasonable care in caring for Plaintiff," reads one part of the complaint. These include general damages for negligence, special damages for medical expenses incurred and anticipated future costs, compensation for permanent or temporary disability, emotional distress damages, loss of earnings both past and prospective, loss of capacity to earn income, and loss of homemaking services. Additionally, she seeks interest as provided by law under California Civil Code §3291 and other relief deemed appropriate by the court.
