Driver Sues Another Motorist for Negligence After Collision

A severe car accident has sparked a legal battle in Ventura County, California. On July 10, 2024, Rosalinda Ruvalcaba filed a complaint in the Superior Court of California against Eugene Joseph Beville, accusing him of negligence and negligence per se.

According to the court documents filed by Alder Law, P.C., Ruvalcaba alleges that on July 15, 2022, she was driving her Lexus eastbound on Main Street in Ventura when Beville's BMW collided with her vehicle at high speed. The incident occurred as Ruvalcaba was stopping at a red light at the intersection of Main Street and Mills Road. Beville allegedly failed to stop and crashed into the rear of Ruvalcaba's car, causing significant damage and injuries.

The plaintiff asserts that Beville had a duty to operate his vehicle safely and breached this duty by driving recklessly and failing to stop at the red light. The complaint states, "Defendant BEVILLE negligently entrusted, owned, maintained, managed, controlled and/or operated the BMW vehicle in such a manner as to cause the collision and Plaintiff's injuries and damages." Furthermore, Ruvalcaba claims that Beville violated California Vehicle Code 22350 by driving at an excessive and unreasonable speed.

As a result of the collision, Ruvalcaba suffered severe bodily injuries, loss of earnings, medical expenses, property damage to her vehicle, and an inability to perform her regular occupation. She is seeking general damages for pain and suffering, special damages for medical expenses and lost wages, pre- and post-judgment interest, costs of suit incurred, and any other relief deemed just by the court.
