Plaintiff accuses motorist of negligence in serious traffic collision

A serious traffic collision has led to a lawsuit filed in Ventura Superior Court, bringing to light allegations of negligence and personal injury. On June 26, 2024, Mary Celine Smith lodged a complaint against Philippa Rachel Roderick Jones, citing severe injuries and damages resulting from the incident.

According to the court documents, the plaintiff, Mary Celine Smith, claims that on August 30, 2022, she was involved in a rear-end collision while stopped at a red light in Westlake Village. The complaint asserts that Jones's negligent driving caused the accident. Smith alleges that Jones failed to properly manage and control her vehicle, leading to significant physical and emotional trauma for Smith. "As a direct and proximate result of the above-described negligence of the Defendants," the document states, "Plaintiff suffered injuries to her health, strength and activity, severe injury to her body and nervous systems."

Smith's legal team argues that these injuries have resulted in ongoing pain and suffering, necessitating medical treatment and potentially leading to permanent disability. The complaint also highlights the financial burden imposed by medical expenses and property damage. Smith is seeking general damages for physical injuries and emotional distress, compensation for property damage including loss of use of her vehicle, as well as reimbursement for past and future medical expenses.

The plaintiff’s attorneys from Sottile Baltaxe law firm are requesting a jury trial to resolve these issues. They are demanding judgment against Jones for an amount according to proof presented during the trial. Additionally, they seek interest as per California Vehicle Code Sections 3288 and 3291.
