California Resident Sues General Motors Over Defective Chevy Silverado

In a compelling legal battle, a California resident has taken on one of the automotive giants, alleging severe violations of consumer protection laws. On June 17, 2024, Juan De Dios Salazar Olivas filed a complaint against General Motors LLC in the Superior Court of California for the County of Ventura.

According to the complaint, Olivas purchased a 2022 Chevy Silverado that has been plagued with numerous defects impairing its safety and functionality. The plaintiff's attorney, Kyle Tracy from Tracy Law, PC, asserts that these issues include auto-stop malfunctions, abnormal vehicle shutdowns, oil leaks, display screen malfunctions, and recurring warning light activations. These defects are said to have manifested within the warranty period provided by General Motors (GM), yet despite multiple repair attempts at authorized GM service centers, the issues remain unresolved.

The lawsuit claims that GM failed to honor both express and implied warranties under the Song-Beverly Consumer Warranty Act. "Defendant has been unable and/or has refused to conform the subject vehicle to the applicable express and implied warranties under the Act after a reasonable number of attempts," reads part of the complaint. Olivas argues that GM is obligated to repurchase or replace the defective vehicle but has intentionally refused to comply with this requirement.

Olivas is seeking various forms of relief from the court. He demands restitution equivalent to the purchase price of the vehicle minus any usage value before discovering these nonconformities. Additionally, he seeks incidental and consequential damages resulting from GM's failure to fulfill its obligations under California's consumer protection laws. Notably, Olivas also requests civil penalties amounting up to twice his actual damages due to what he describes as GM’s willful non-compliance with statutory requirements.

The case is being overseen by Judge Brenda L. McCormick in Ventura Superior Court under Case No. 2024CUPL025990. Representing Olivas is attorney Kyle Tracy from Tracy Law PC.
