Quinn Emanuel Partner Anthony Alden and Associates Elijah Turner and Andrew Shifren have contributed to the American Bar Association (ABA)’s International Law News Spring Issue.

Their article, titled "Intensifying Storms and Intensifying Risks: Merchant Generators Underestimate the Increasing Risk of Grid’s Capacity Regimes," explores the widespread power outages across the United States caused by the December 2022 Winter Storm Elliot. Following this event, PJM and ISO-NE, the entities responsible for managing the electricity grid, imposed significant penalties totalling $1.8 billion in the PJM region and $39 million in New England. In light of the growing impact of climate change on extreme weather events, this article highlights the need for companies to reassess their participation in these initiatives in order to proactively mitigate risks.
