Woman sues Los Robles Hospital for wrongful detention and abuse

On February 1, 2023, Rosella Vera was hospitalized at Los Robles under a Welfare & Institution Code section 5150 hold. She was informed she would be released after a 72-hour hold but was subsequently detained beyond this period without her consent. During her detention, Vera alleges she was forcefully medicated and physically abused by hospital staff.

Vera claims that the hospital staff inflicted severe physical injuries including nerve damage and hematomas from being dragged and physically restrained. She also asserts that she suffered emotional distress due to the wrongful confinement and forced medication without proper psychiatric evaluation or consent.

Ms. Vera has filed a lawsuit against Los Robles Hospital and unnamed defendants in the Superior Court of California, County of Ventura (Case No: 2023CUPPO12994) on August 17, 2023. The lawsuit alleges battery, assault, false imprisonment, intentional infliction of emotional distress, vicarious liability, negligent supervision, and medical battery.

The plaintiff seeks general and special damages according to proof at trial, punitive damages to punish the defendants for their alleged misconduct, prejudgment interest, costs of suit including attorney's fees, and any other relief deemed just by the court.
