Cindy sues Jerzy for failure to maintain rented premises resulting in bed bug infestation

Cindy N. Pimentel, individually and as Guardian ad Litem for Angel Jr. Tejeda, a minor, has filed a lawsuit against Jerzy S. Poprawski, individually and as Trustee of the Jerzy S. Poprawski Trust dated September 7, 2021; JJ Pop Enterprises, a California Sole Proprietorship; and Does 1 – 20, inclusive. The case was filed in the Superior Court for the State of California, County of Ventura on September 19, 2023 with the case ID: 2023CUPPO14459.

The plaintiff's lawyers are Brian J. Virag, Luiza Patrikyan, and Tro Semerjian from MyBedBugLawyer Inc., who argue that the defendants failed to maintain or repair the rented premises at 850 Jane Dr., Port Hueneme, California where Pimentel and Tejeda resided in Unit #11. They claim that this failure resulted in bed bug infestation and other deplorable living conditions which violated Civil Code §§ 1941, 1941.1 & Health and Safety Code (H&S) §§ 17920, 17920.3.

The lawsuit alleges that due to these uninhabitable conditions and ongoing bed bug infestations at the property, plaintiffs endured slum-type living conditions resulting in financial loss, property loss, personal injury and emotional distress. It further states that defendants failed to disclose or warn plaintiffs about these filthy infestations.

Pimentel is seeking equitable relief along with monetary and punitive damages against all defendants for their wanton failure to properly maintain or repair her rented premises causing personal injuries including painful bed bug bites, severe skin rash, allergic reaction among others; property damage to beddings and furniture; relocation expenses; pest control fees; loss of earnings; attorney fees; ongoing emotional distress; mental anguish.
