Brinan Weeks sues Interactive Life Forms for false advertising and misrepresentation

In a lawsuit filed in the Court of Appeal of the State of California, Second Appellate District, Division One (Case ID: B323430), plaintiff Brinan Weeks has taken on defendant Interactive Life Forms, LLC. The case was filed on March 25, 2024 and revolves around allegations of false advertising and misrepresentation by the defendant.

Weeks alleges that Interactive Life Forms, which operates an online business selling sex toys under the brand name Fleshlight, falsely advertised its product - a device called Stamina Training Unit (STU). He claims that despite using the product as directed for several months, there was no improvement in his sexual performance or stamina. The suit was represented by Russell Law's L. David Russell and Qureshi Law's Omar G. Qureshi while Sullivan Johnson and Daniel A. Johnson defended Interactive Life Forms.

The plaintiff seeks to represent a class-action suit against Interactive alleging violations of the Consumer Legal Remedies Act, false advertising, breach of express and implied warranty, and violation of the Unfair Competition Law. Interactive responded by moving to compel arbitration based on their website's terms of use which mandate mediation and arbitration for any disputes related to access or use of their website.
