In the Superior Court of California, County of Ventura, a lawsuit was filed by plaintiff Christopher Davis against defendants Diane Weschta and Michelle Diane Guillen aka Michelle Diane Weschta on August 11, 2023. The case ID is 2023CUORO1245 and it pertains to violations of building code and private nuisance.

The plaintiff's attorney is Brian A. Osborne from the Law Offices of Brian A. Osborne. The plaintiff alleges that the defendant illegally installed an HVAC condenser unit in her property at 3836 San Clemente Court, Thousand Oaks, which is in violation of Thousand Oaks Building Code Sec. 9-4.2505 regarding side yards. The HVAC unit was installed three and a half feet from the plaintiff's property line instead of the required five feet.

Davis claims that the noise and vibration from the HVAC unit, which is directed horizontally towards his home, have created a miserable situation for him by disturbing his peace and quiet. Despite receiving violation letters from the city attorney and other city officials, Guillen has failed to relocate her HVAC unit.

Davis seeks damages for the disturbance caused by the noise and vibration from Guillen's HVAC unit and for her failure to comply with building codes.
